Salam. I want to ask that if a man issues a divorce to his wife by saying only the word ‘Talaaq’ when a man is extremely angry, in physical and mental pain and with a couple of minutes realises what he has done and regrets it, will this count as first divorce. And if the first divorce is given and the man takes his wife back within that short time frame (5 to 30 mins) then is this first divorce valid for ever? I hat I mean to ask is if the man then divorces the women after 5 years for example, will that then count as a first divorce or as the second divorce? JazakAllah al kher for your help.
You enquire if the first divorce issued by the husband in a state of extreme anger, afflicted with physical and mental pain will be valid.Extreme anger to the point of insanity, where one is unaware of what he is saying will not constitute the Talaaq. It is necessary that the person has a previous medical history of insanity or has been diagnosed by a doctor of having an unstable mind.However, the stage of anger where the person’s mind is sound and is aware of what he is saying will constitute Talaaq.[1]In principle, a revocable divorce (Talaaq Raj’ie) is a type of divorce wherein the husband divorces his wife using explicit terms. For example, he says “I divorce you”, or “I give you Talaaq”.
